ALGEMEEN

Privacy is een grondrecht van ieder individu. Maggie’s Melody wil uw vertrouwde partner zijn en waakt erover dat uw persoonsgegevens maximaal beschermd worden. Zij stelt alles in het werk om deze gegevens met respect en op een correcte en transparante manier te verwerken, de privacy van ieder individu te waarborgen en misbruik van deze gegevens te voorkomen.

Desalniettemin heeft Maggie’s Melody voor het uitvoeren van haar opdrachten, alsook voor de werking van haar website, evenwel bepaalde gegevens van de klant/gebruiker nodig. In dit Privacybeleid wordt een overzicht gegeven van wat Maggie’s Melody met deze gegevens doet en de juridische gronden waarop dit gebaseerd is. Tevens worden de rechten opgesomd die u als betrokkene met betrekking tot de verwerking van uw persoonsgegevens kan laten gelden. 

Lees onderhavig Privacybeleid aandachtig door, want het bevat essentiële informatie over hoe uw persoonsgegevens verwerkt worden.

Door het verstrekken van uw persoonsgegevens aan Maggie’s Melody, verklaart u kennis te hebben genomen van dit Privacybeleid.  

Het Privacybeleid kan op ieder ogenblik worden herwerkt en geüpdatet teneinde aan de geldende privacywetgeving te blijven tegemoetkomen. 

ARTIKEL 1. WETTELIJK KADER 

Maggie’s Melody verwerkt de persoonsgegevens steeds in overeenstemming met de geldende Belgische en Europese privacy reglementering, waaronder:

• de Wet van 8 december 1992 tot bescherming van de persoonlijke levenssfeer ten opzichte van de verwerking van persoonsgegevens, evenals de wijzigingen aan deze wet;

• de anti-spambepalingen uit Boek XII van het ‘Wetboek Economisch Recht omtrent het recht van de elektronische economie;

• de Europese Verordening 2016/679 van 27 april 2016 betreffende de bescherming van natuurlijke personen in verband met de verwerking van persoonsgegevens en betreffende het vrije verkeer van die gegevens en tot intrekking van Richtlijn 95/46/EG’ (ook de ‘AVG’ of de ‘GDPR’ genoemd).

ARTIKEL 2. TOEPASSINGSGEBIED

Onderhavig Privacybeleid is van toepassing op de verwerking van ‘persoonsgegevens’ in het kader van de door Maggie’s Melody te verrichten werkzaamheden of te verlenen diensten waartoe de klant opdracht heeft gegeven. 

Het beleid is eveneens van toepassing op de website van Maggie’s Melody, evenals op alle andere (commerciële) relaties tussen Maggie’s Melody en haar klanten, opdrachtgevers, prospecten, zakenpartners, medewerkers en personeel.

Onderhavig Privacybeleid is niet van toepassing op de verwerking van andere dan de hierna vermelde persoonsgegevens. Het spreekt evenwel voor zich dat Maggie’s Melody zich in het algemeen tot een strikte geheimhouding houdt in de meest brede zin van het woord voor wat betreft de gegevens en informatie die door de klanten worden aangereikt.  

 

ARTIKEL 3. DEFINITIE

Voor de toepassing van dit Privacybeleid wordt onder ‘Persoonsgegevens’ verstaan: “Alle informatie over een geïdentificeerde of identificeerbare natuurlijke persoon.”

Als ‘identificeerbaar’ worden die gegevens beschouwd die ervoor zorgen dat een natuurlijke persoon direct of indirect kan worden geïdentificeerd. 

Dit betreffen onder meer:

• persoonlijke identificatiegegevens;

• contactgegevens;

• locatiegegevens;

• andere persoonlijke informatie zoals elementen die kenmerkend zijn voor de fysieke, fysiologische, genetische, psychische, medische, economische, culturele of sociale identiteit van de betrokken natuurlijke persoon.

ARTIKEL 4. VERZAMELING PERSOONSGEGEVENS

Maggie’s Melody kan uw persoonsgegevens op volgende manieren vergaren (niet-limitatieve opsomming):

• wanneer u deze zelf aanreikt aan haar: 

• bij het bezoek op haar website zonder enige vorm van registratie (via cookies);

• bij het invullen van contact- en inschrijvingsformulieren op de website of bij het inplannen van een afspraak/activiteit via een ander kanaal;

• in het algemeen bij alle inkomende en uitgaande correspondentie met Maggie’s Melody via diverse kanalen (online, elektronisch of per telefoon/gsm);

• bij het invullen of ondertekenen van (inschrijvings)formulieren, lidmaatschapsaanvragen en overeenkomsten die Maggie’s Melody u voorlegt in het kader van de uitvoering van of voorafgaandelijk aan de uitvoering van de overeenkomst/opdracht;

• in het algemeen om lid te worden van de verenging en bij het uitvoeren van de overeenkomst/opdracht voor de klant;

• voor het klantenbeheer en de facturatie;

 

• wanneer deze gegevens vrij raadpleegbaar zijn of verkregen kunnen worden via bronnen van informatie die publiekelijk toegankelijk zijn (zoals eigen website van de klant of profiel, de Kruispuntbank van Ondernemingen, Belgisch Staatsblad en dergelijke meer).

 

ARTIKEL 5:  WELKE PERSOONSGEGEVENS?

Maggie’s Melody verwerkt volgende persoonsgegevens die relevant zijn in de professionele context:

• Categorie 1: Identificatiegegevens:

• Voornaam;

• Achternaam;

• Eventueel: leeftijd;

• Eventueel: geslacht;

• Eventueel: geboorteplaats- en datum.

 

• Categorie 2:  Contact- en locatiegegevens:

• Adres: straat, huisnummer, eventueel busnummer, postcode, gemeente/stad, land;

• E-mailadres;

• Telefoonnummer en/of gsm-nummer;

 

• Categorie 3:  Elementen die kenmerkend zijn voor de fysieke en fysiologische identiteit van de betrokken natuurlijke persoon:

• Stemsoort;

• Afbeeldingen onder de vorm van foto’s en video’s van de klant (zie infra);

• Categorie 4: Financiële gegevens:

• Bankrekeningnummer voor betaling via overschrijving;

• Overige Bankkaartgegevens in het kader van online betaling;

• Categorie 5: Online gegevens:

• IP-adres, Internet browser en apparaat type;

• gegevens over uw activiteiten op de website van Maggie’s Melody (surfgedrag);

 

• Categorie 6: Overige gegevens:

• Ervaring- en/of vormingsniveau met betrekking tot het voorwerp van de opdracht;

ARTIKEL 6: DOELEINDEN EN RECHTSGRONDEN VAN DE VERWERKING

Maggie’s Melody verwerkt uw persoonsgegevens voor volgende (niet-limitatief opgesomde) doelen:

• Aanmaak lidmaatschap/aangaan overeenkomst;

• Klantenbeheer, personeelsbeheer en beheer van de leveranciers;

• Boekhouding;

• Afsluiten (verplichte) verzekeringen;

• Rapportering aan subsidiërende overheden;

• Agendaplanning;

• Communicatie met de klant/opdrachtgever/leverancier/personeel;

• Uitvoering van de overeenkomst/opdracht en/of levering van de diensten;

• Direct marketing: versturen van uitnodigingen en nieuwsbrieven over de diensten van Maggie’s Melody of voor evenementen (opleidingen, vormingen, optredens en andere activiteiten) aangeboden door Maggie’s Melody of overkoepelende organisaties; 

• Referentie en/of verslaggeving in (gedrukte of online)communicatiekanalen;

• Verbetering dienstverlening of dagelijkse werking;

• Analyse surfgedrag;

• Optimalisatie website en aanbod;

 

De toepasselijke wetgeving laat toe om persoonsgegevens van natuurlijke personen te verwerken met het oog op het vervullen van voormelde doeleinden, doch enkel op voorwaarde dat minstens één van volgende juridische verwerkingsgronden van toepassing is:

• ofwel uw toestemming: Maggie’s Melody kan om uw specifieke toestemming vragen om bepaalde persoonsgegevens te verwerken en zal dit dan ook enkel doen indien u daadwerkelijk uw toestemming heeft gegeven. Zo verzamelt en verwerkt zij bijvoorbeeld de gegevens die zij van u ontvangt wanneer u zich aanmeldt voor haar nieuwsbrief. Hiervoor geeft u uw expliciete toestemming. Hetzelfde geldt wanneer u instemt voor een gerichte foto, videomateriaal of geluidsopname met het oog op de verslaggeving ervan op de website of de overige social media kanalen. Uiteraard kan deze toestemming nadien steeds ingetrokken worden

Door zelf persoonsgegevens aan Maggie’s Melody aan te reiken, geeft u haar uw expliciete toestemming dat zij deze gegevens mag gebruiken in overeenstemming met onderhavig Privacybeleid;

Uitzondering: Maggie’s Melody verwerkt enkel gegevens van minderjarigen mits toestemming van de ouders en/of wettelijke voogd. Maggie’s Melody is evenwel gevrijwaard van elke aansprakelijkheid bij het niet naar waarheid doorgeven van de correcte leeftijd of een vervalsing op dit punt. Er bestaat dienaangaande geen verificatieplicht in haar hoofde.

 

• ofwel de noodzaak voor de uitvoering van de overeenkomst/opdracht en/of de levering van de diensten: dit is wanneer de verwerking van uw persoonsgegevens noodzakelijk is om de verplichtingen uit hoofde van een overeenkomst of de intentie om een overeenkomst aan te gaan, na te komen;

• ofwel wettelijke, reglementaire en/of deontologische verplichtingen of gewichtige redenen van algemeen belang: dit is wanneer Maggie’s Melody verplicht is uw persoonsgegevens te verwerken om aan een wettelijke verplichting te voldoen, zoals het bijhouden van gegevens voor (overheids)doeleinden of het verstrekken van informatie aan een wetgevingsinstantie (vb. voor de instelling, uitoefening of onderbouwing van een rechtsvordering);

• ofwel een gerechtvaardigd belang van de onderneming: Maggie’s Melody mag uw persoonsgegevens verwerken indien dit in haar legitiem belang is om een wettige activiteit te runnen of om deze activiteit te bevorderen;

 

ARTIKEL 7: DOORGIFTE AAN DERDEN

Maggie’s Melody zal uw persoonsgegevens in geen geval verkopen of commercieel ter beschikking stellen aan direct marketingbureaus of gelijkaardige dienstverleners (voor louter commerciële doeleinden), tenzij met uw voorafgaande toestemming. 

Maggie’s Melody is evenwel gerechtigd uw persoonsgegevens door te geven aan derde dienstverleners, die haar bijstaan bij haar dienstverlening, indien dit noodzakelijk is voor het uitvoeren van de opdracht, zoals onder meer doch niet beperkt, aan:

• de verzorgers van de internetomgeving en de IT-infrastructuur, te weten: IT-leveranciers, websitebeheerders, partners die dataopslag in de cloud beheren, mail en service providers, virtuele assistenten edm.;

• logistieke partners;

• sociaal secretariaat;

• verzekeraar;

Deze spelers krijgen toegang tot uw persoonsgegevens, maar alleen in de mate dat dit strikt noodzakelijk is om hun activiteiten uit te voeren. Zij mogen uw gegevens niet aanwenden voor andere doeleinden.  

Daarnaast kan Maggie’s Melody uw persoonlijke gegevens ook bekendmaken aan die entiteiten/personen die namens haar en/of voor haar rekening optreden (personeel, werknemers, aangestelden, zelfstandige medewerkers,…), doch enkel voor doeleinden van assistentie. Hetzelfde geldt voor de koepelorganisaties waarmee Maggie’s Melody samenwerkt, waaronder ‘Koor&Stem (provinciaal en nationaal)’. Maggie’s Melody staat er voor in dat eenzelfde niveau van beveiliging en vertrouwelijkheid van uw gegevens wordt gewaarborgd door deze personen, die eveneens onder het toepassingsgebied van dit Privacybeleid vallen.

In bepaalde situaties zal Maggie’s Melody ook genoodzaakt zijn persoonsgegevens openbaar te maken om te voldoen aan wettelijke verplichtingen of in het openbaar belang of om redenen van wetshandhaving. Dit kan onder meer:

• op verzoek van de overheidsdiensten;

• in reactie op dagvaardingen of in het kader van juridische procedures;

 

In het geval dat de activiteiten van Maggie’s Melody worden verkocht of samengevoegd met een ander bedrijf, kunnen uw persoonsgegevens worden bekendgemaakt aan de curator of de adviseur van een potentiële koper/overnemer en kunnen ze worden doorgegeven aan de nieuwe eigenaar(s) van het bedrijf. In dat geval neemt Maggie’s Melody evenwel de gepaste maatregelen om de integriteit en vertrouwelijkheid van uw persoonsgegevens te verzekeren.

Gaat het om doorgifte van uw persoonsgegevens aan derden die zich bevinden in landen buiten de Europese Economische Ruimte (EER), dan zal Maggie’s Melody dit maar rechtmatig doen indien de ontvanger van de gegevens zich bevindt in een land dat een passend beschermingsniveau biedt of indien de ontvanger lid is van een land waarvoor een adequaatheidsbesluit bestaat. Is dit niet het geval dan verbindt Maggie’s Melody zich ertoe nog bijkomende passende waarborgen te stellen. Gegevens zullen dan enkel doorgegeven worden nadat met deze partij een modelcontract (standard contractual clauses) vastgesteld door de Europese Comissie werd afgesloten of op basis van een gedragscode die voorafgaandelijk is goedgekeurd.

 

ARTIKEL 8: DUUR VAN DE VERWERKING

Maggie’s Melody zal uw persoonsgegevens niet langer bewaren dan de verplichte wettelijke termijn voorschrijft of - indien een dergelijke wettelijke termijn niet van toepassing is - niet langer dan strikt noodzakelijk is voor het realiseren van de doeleinden waarvoor uw persoonsgegevens zijn verzameld, doch nooit langer dan tien jaar na de dienstverlening.

Indien de verwerking van uw persoonsgegevens gebaseerd is op uw voorafgaande toestemming (zoals bijvoorbeeld voor marketing doeleinden), dan zullen deze gegevens bewaard worden zolang uw toestemming geldt.

 

ARTIKEL 9: UW RECHTEN

Recht van toegang en inzage

U heeft het recht om op elk moment gratis kennis te nemen van uw persoonsgegevens, alsook van het gebruik dat Maggie’s Melody van uw persoonsgegeven maakt.

Recht van verbetering, verwijdering en beperking

U heeft steeds het recht te verzoeken uw persoonsgegevens te verbeteren, aan te vullen of te verwijderen.  U mag eveneens vragen om de verwerking van uw persoonsgegevens te beperken.

U erkent evenwel dat bij weigering van mededeling of verzoek tot verwijdering van persoonsgegevens, bepaalde diensten niet leverbaar kunnen zijn.

Recht van verzet

U beschikt eveneens over een recht van verzet  tegen de verwerking van uw persoonsgegevens om ernstige en legitieme redenen.

Daarnaast heeft u steeds het recht om zich te verzetten tegen het gebruik van uw persoonsgegevens voor doeleinden van direct marketing (commerciële doeleinden). In dergelijk geval hoeft u zelf geen redenen op te geven.

Recht van vrije gegevensoverdracht

U beschikt over het recht om uw persoonsgegevens die door Maggie’s Melody verwerkt worden in gestructureerde, gangbare en machineleesbare vorm te verkrijgen en/of aan andere verantwoordelijken over te dragen.

Recht van intrekking van de toestemming

Voor zover de verwerking gebaseerd is op uw voorgaande toestemming, beschikt u steeds over het recht om die toestemming in te trekken.

Uitoefening van uw rechten

U kan uw rechten uitoefenen door Maggie’s Melody per mail of per brief te contacteren op bovenvermelde contactgegevens.

Maggie’s Melody houdt zich eraan binnen een redelijke termijn te reageren op uw verzoek.

ARTIKEL 10. BEVEILIGINGSMAATREGELEN EN AANSPRAKELIJKHEID

Maggie’s Melody stelt alles in het werk om uw gegevens te beschermen en om te voldoen aan de geldende wet- en regelgeving. Ze neemt daarom verschillende fysieke, administratieve, technische en organisatorische beveiligingsmaatregelen om uw gegevens te beschermen tegen eventuele vernietiging, verlies of wijziging. Naar haar best vermogen zorgt Maggie’s Melody ervoor dat de toegang tot uw persoonsgegevens enkel wordt verschaft aan personen voor wie dit noodzakelijk is. Personen die toegang tot de gegevens hebben, zijn verplicht deze gegevens geheim te houden. De medewerkers van Maggie’s Melody zijn geïnformeerd over het belang van onderhavig Privacybeleid. Zij hanteert een gebruikersnaam en wachtwoordbeleid op haar interne systemen. Gegevens op papier worden bewaard achter slot of in ruimten waar derden geen toegang tot hebben.

Dit betreft een inspanningenverbintenis in hoofde van Maggie’s Melody. Niettegenstaande voormelde maatregelen en verregaande inspanningen van Maggie’s Melody, kunnen haar beveiligingsbeleid, de controles die zij uitvoert en de acties die zij in dit kader voorstelt, geen onfeilbaar veiligheidsniveau garanderen. Aangezien geen enkele methode van verzending (al dan niet via internet), noch enige methode van elektronische opslag honderd procent veilig is, kan Maggie’s Melody in deze context geen absolute veiligheid garanderen en de risico’s volledig uitsluiten. 

Maggie’s Melody maakt zich evenwel sterk om onmiddellijk actie te ondernemen indien uit een controle zou blijken dat bepaalde aspecten van haar beleid of procedures niet zouden voldoen aan de geldende normen van een redelijk beleid.

In geen geval kan Maggie’s Melody aansprakelijk worden gesteld voor enige directe of indirecte schade die voortvloeit uit een foutief gebruik of een nalatig handelen door uzelf bij het verstrekken van uw persoonsgegevens. U bent dus als enige verantwoordelijk voor het gebruik dat wordt gemaakt van de website van op uw computer, IP-adres en van uw identificatiegegevens, alsook voor de vertrouwelijkheid ervan.

Noch kan Maggie’s Melody aansprakelijk worden geacht voor enige directe of indirecte schade die voortvloeit uit een foutief of onrechtmatig gebruik door een derde van uw persoonsgegevens. Maggie’s Melody geeft geen verklaringen of garanties met betrekking tot hoe gebruiksgegevens worden opgeslagen of gebruikt op servers van derden.

Wat zijn cookies en waarvoor worden ze gebruikt?

Cookies zijn kleine bestanden uitgezonden door de server van Maggie’s Melody en geplaatst op de harde schijf van uw computer. Cookies worden gebruikt om uw gebruiksvoorkeuren te onderscheiden van die van andere gebruikers van de website. Dit helpt om je een betere gebruikservaring te bieden wanneer je de website bezoekt en laat Maggie’s Melody ook toe haar website te optimaliseren.

ARTICLE 6: PURPOSES AND LEGAL BASIS OF PROCESSING
